PREAMBLE – HERTZ Morocco

1. Preamble

The following general conditions of sale govern all transactions established on the web catalog of STARC S.A.S.. Any order placed on this site assumes the customer's unconditional and irrevocable acceptance of these conditions.

2. Subject

This contract is a distance contract whose purpose is to define the rights and obligations of the parties in connection with the sale of products of the company STARC S.A.S on the Internet, through the platform Maroc Télécommerce. www.hertz.ma a service and a trademark registered by STARC S.A.S Maroc Télécommerce is a service of transaction management and a trademark registered by Maroc Télécommerce S.A.S

3. Method of payment

To pay your order by credit card, you choose the payment method among those proposed by STARC S.A.S. at the level of the Order Form (Visa, MasterCard, Maestro, cmi, Diners Club and Discover).

In this case, the remittance of the transaction for debiting your account is made within one day after the date of confirmation of delivery.

Your payment by credit card is secured by Maroc télécommerce which offers a fully secure payment service.

The Consumer guarantees the Company STARC S.A.S that he has the necessary authorizations to use the method of payment chosen by him, when validating the Order Form.

In case of payment by credit card, the provisions relating to the fraudulent use of the means of payment provided in the agreements concluded between the Consumer and the issuer of the card between STARC S.A.S. and its banking institution shall apply.

4. Proof of transactions paid by credit card

The data recorded by Maroc télécommerce S.A.S on the Maroc télécommerce platform on behalf of STARC S.A.S constitute proof of all commercial transactions between you and the company STARC S.A.S

GENERAL RENTAL CONDITIONS - HERTZ MOROCCO GENERAL INFORMATION

Age and Driving License

When picking up the vehicle, you must present a valid national driving license. The license must be Moroccan, European or international. The license must be valid for at least 1 year depending on the group of vehicle rented (Details below)The minimum age for the rental depends on the group of the rented vehicle.

Group 1: Minimum age 21 + 1 year of license validity Category: MDMR, MDMN, MDAR, MDAN, ECMR, ECMD, ECMN, EDMN, EDMD, EXMD, EXMN, ECAR, ECAN, ECAD, EGAR, CDMD, CDMN, CDAR, CDAN, CMMD, CMMN, CFAD.

Group 2: Minimum age 23 years + 2 years of license validity Category: Other categories

A young driver surcharge of 360 MAD TTC per rental will be applied

Accepted means of payment

For your convenience, we recommend that you pay for your rental with a HERTZ approved credit card.

Payment of the estimated rental amount will be required upon departure of the vehicle.

In the case of the application of a promotional rate, the non-respect of the rental period planned when picking up the vehicle, will systematically lead to the invoicing of the public rate in force according to the period.

A deposit in credit card (CB, VISA, EUROCARD, AMERICAN EXPRESS) will be required at the time of pick-up. This card must imperatively be in your name and surname. Visa debit, electron and maestro cards are not accepted for the security deposit.

The amount of the deposit is equal to the amount of the deductible (CF Section DEDUCTIBLE & OPTIONAL GUARANTEES).

For the purposes of the rental of the vehicle, STARC, in its capacity as Renter, will proceed with the customer's bank, which the latter will have designated, to a request for pre-authorization of the amount of the deposit useful for the duration of the rental of the vehicle reserved.

If the bank refuses to provide this pre-authorization, the reservation for the vehicle rental will be cancelled and the client will be reimbursed for the amount of the prepaid reservation minus the cancellation/no-show fee. (see section on MODIFICATION - CANCELLATION - NO SHOW).

Territory

The "Territory" means the country in which the circulation of the rented vehicle is authorized, namely MOROCCO

THE RATE

Our rates include :

  • The oil, the maintenance and the documents of edge;

  • The provision of the vehicle;

  • Unlimited civil liability insurance and accidents caused to third parties;

  • Limited or unlimited mileage.

Our rates do not include :

  • The incompressible deductible or the deductible in case of theft of the vehicle (see paragraph insurance and additional protection);

  • Fuel : vehicles must be returned with the same level of fuel as at departure. If this is not the case, the missing fuel will be invoiced at the public price in addition to the refuelling costs of up to 240 MAD including tax;

  • Delivery costs for duplicate keys (in case of damage, loss or theft): 240 MAD including VAT.

The rates applicable to the rental, to the additional services, to the guarantees or optional insurances are those in force at the time of the signature of the contract and correspond to the conditions that you have exposed (duration, return station...). Any modification of these conditions will lead to the application of another tariff corresponding to the new conditions. The vehicle is provided to you with a minimum of 3/8 of fuel. You must return it in the same condition. If you fail to do so, you will be invoiced for the number of litres of fuel missing.

A handling fee of 500 MAD including VAT will be retained by the Hirer on the deposit for the processing of any fines and penalties that may be imposed on the Hirer during the rental period.

The reservation is confirmed by vehicle category only, not by model.
HERTZ SUPPLEMENTS

Mileage Pass Option: For rentals limited to 100km/day, it is possible to subscribe to a mileage pass of 50km or 100km per day in order to benefit from additional mileage. On return of the vehicle, any excess mileage over and above that included in the rental and not covered by the purchase of a Mileage Pass will be charged at the close of the contract.

Airport Surcharge: A surcharge of 240 MAD including VAT applies to any rental made from the airport.

Additional driver" supplement: only the main driver is allowed to drive the HERTZ vehicle.

  • The name that appears on the booking form must be that of the main driver, present at the signature of the contract and responsible for the rental fees;

  • Any additional driver must be mentioned on the contract when picking up the vehicle in order for the insurance cover to be effective;

  • Each additional driver must be mentioned on the contract when picking up the vehicle in order for the insurance cover to be effective. The additional driver will be charged at 100 MAD / TTC per day, with a maximum of 600 MAD / TTC per contract;

  • The spouse of the main driver is considered as an additional driver. Young driver" supplement: for drivers or additional drivers over 21 & under 23 years old with a valid licence for one year, a supplement of 360 MAD (incl. VAT) will be charged regardless of the rental period.

Dirty vehicle" supplement: any vehicle returned excessively dirty (animal hair, sand, mud, stained saddlery, etc.) will be subject to a complete cleaning charged between 500 MAD and 1500 MAD including tax.

Delivery / Collection outside opening hours.

For any provision of a vehicle outside the opening and closing hours displayed in HERTZ agencies, additional costs of delivery or return "out of hours" amounting to 500 MAD including VAT will be charged to the hirer when establishing and/or closing the contract.

Vehicle equipment :

All vehicles are equipped with a fluorescent waistcoat and a warning triangle. If the safety kit is returned incomplete or is lost, a penalty of 360 MAD including VAT will be charged.

  • Baby seat: 70 MAD (incl. tax) per day, up to a maximum of 600 MAD (incl. tax).

  • Booster seat: 36 MAD including tax per day, up to a maximum of 360 MAD including tax.

THE RENTED VEHICLE

Condition of the vehicle

A description of the vehicle is attached to your contract. You undertake to record in writing, before your departure from the station, any apparent defect that is not included. If you fail to do so, we will be deemed to have delivered a vehicle that conforms to the description. Unfortunately, we will not be able to take into account any claims for apparent damage that have not been reported at the time of departure. You must return the vehicle in the condition in which you received it. Any costs incurred in repairing the vehicle due to the fault of the hirer or in the absence of fault on the part of an identified third party will be added to the cost of the hire, subject to the provisions of the "optional contractual guarantees" section.

Use of the vehicle

You must never use the Vehicle outside the Territory.

In accordance with the principle of the personality of the penalty, you are responsible for offences committed during the rental period. Therefore, you are informed that your details may be communicated to the police authorities upon request.

You undertake to use the vehicle in a "good fatherly manner" and in particular, without being under the influence of alcohol or narcotics or any substance likely to affect driving in accordance with the provisions of the Highway Code and to use it in accordance with its intended purpose, which, for a private vehicle, is mainly that of transporting people free of charge and for a commercial vehicle, is mainly that of transporting goods.

In the event that the conditions of use of the rented vehicle are subject to specific regulations, you are responsible for compliance with these regulations throughout the contract. Furthermore, any infringement of these regulations obliges the Hirer to compensate the Hirer for any damage that the latter may suffer. We would particularly like to draw your attention to the dimensions of the commercial vehicles (shown inside the passenger compartment and on the "vehicle condition" sheet for the height) which require increased attention during certain manoeuvres (reversing for example) and may make it impossible to cross certain road infrastructures (tunnels, bridges, etc.), the maximum height of which is, according to the regulations in force, indicated in advance.

CAUTION : In the event of a misjudgement of the vehicle's size, the impact on the top of the body and under the body is not covered by the damage guarantee unless it can be proved that it is a case of force majeure. You must not use the rented vehicle in particular :

1. To re-let it;

2. For the transport of persons for payment;

3. For the carriage of more persons than are stated in the vehicle's registration document;

4. To participate in rallies, competitions or tests, regardless of the location and conditions;

5. To give driving lessons;

6. Pushing or pulling another vehicle (except vehicles fitted with a hook - maximum load 1000 kg);

7. For roads that are not passable or whose surface or state of maintenance presents risks for the tyres or the organs under the vehicle;

8. To commit an intentional offence;

9. Goods and luggage carried in the vehicle, including their packaging or stowage, must not damage the vehicle or cause abnormal risks to its occupants;

When you park the vehicle, even for a short stop, you undertake to lock the vehicle and to use the alarm and/or anti-theft devices with which the vehicle is equipped. You must never leave the car unoccupied with the keys in the ignition. Failure to return the keys will result in the loss of the theft cover.

10. In the event of damage or theft, you must send to the Hirer, within a period not exceeding 2 days, the accident report or the receipt of declaration of theft issued by the authorities, as well as the keys and papers of the vehicle.

ATTENTION : This article sets out the minimum obligations to be respected during the period in which you have custody of the vehicle.

Maintenance / Mechanical problems

During your rental period and depending on the number of kilometres driven, you will have to carry out the usual checks (engine oil level, water level, tyre pressure, etc.), in accordance with "good family practice". In this respect, the Hirer shall remain vigilant to any warning lights on the vehicle's dashboard, if any, and shall take all necessary precautionary measures, if any, such as emergency stop.

The vehicle is supplied to you with tyres in the condition and number required by road regulations. In the event of deterioration of one of them for a reason other than normal wear and tear, latent defect or force majeure, you undertake to replace it immediately and at your own expense with a tyre of the same size, type and brand, and of equal wear and tear. In the event of a mechanical breakdown or accident, you benefit from an Assistance Service, included in the price of your rental. The conditions of this assistance are set out in the leaflet "Insurance, Assistance and Useful Advice Conditions" which is available in all branches.

If the odometer has not worked for any reason other than a technical fault, the hirer will have to pay the kilometre allowance calculated on the basis of 100 kilometres per day of hire. Any transformation or mechanical intervention on the vehicle is forbidden without prior authorisation from the Renter.

DURATION OF THE LEASE

Concept and calculation

The duration of a rental contract is 30 days maximum. The hirer undertakes to return the vehicle to the Hirer on the date stipulated in the rental contract, failing which he/she will be liable to civil and criminal legal proceedings. The rental period is calculated by 24-hour periods, which cannot be split up, from the time the vehicle is made available.If you wish to renew the contract, you must :

  • Go with the vehicle to the HERTZ branch of departure, or to the nearest branch;

  • To check the vehicle with the HERTZ agent;

  • To pay the rent and additional charges when the contract expires and to sign a new contract.

The renewal of a monthly contract is strictly subject to the above stipulations. Moreover, the failure of the Hirer to comply with these stipulations for monthly rentals will automatically render him/her liable to the Hirer for a conventional penalty of five hundred (500) MAD (including tax) per day of retention of the vehicle beyond the expiry date of the contract, in addition to the cost of the rental and without prejudice to the Hirer's right to take any civil and/or criminal action on the basis of the non-return of the vehicle.

Delay in collecting the vehicle

The reservation will be held until two hours after the scheduled pick-up time, unless you have contacted the reservation centre to change your arrival time. After this two-hour period, the vehicle will be made available to other customers. If you arrive after the two hours, we will do our best to provide you with a vehicle, but availability cannot be guaranteed.

RETURN OF VEHICLES

The rental ends with the return of the vehicle and its keys to a uniformed agent on the premises. The return of the vehicle must take place during the opening hours of the HERTZ branch; only the taking of the vehicle, the documents and the keys by the agent of the Hirer, during the opening hours of the branch concerned, allows the termination of the rental contract.

If you are slightly late in returning the vehicle, we grant you a 59 minute extension, after this "Grace Period", you will have to pay an additional day.Any vehicle returned outside of opening hours remains the responsibility of the hirer. The time of return of the vehicle to close the contract and determine the amount of the invoice, will be the time of the next opening of the agency.

In the event that the vehicle is returned without its keys, these will be invoiced to the hirer as well as, if necessary, the costs of repatriation and immobilisation of the vehicle.The Hirer can in no way be held responsible for goods that have been left in the vehicles at the end of the rental period.
TERMINATION OF THE CONTRACT

In the event of confiscation or sealing of the vehicle, the rental contract may be terminated by operation of law as soon as the lessor is informed by the legal authorities or by the lessee.Any use of the vehicle that is detrimental to the lessor shall entitle the lessor to terminate the contract by operation of law. In the event of theft, the rental contract shall be terminated upon transmission to the lessor of the complaint filed by the lessee with the competent authorities.

INSURANCE AND ADDITIONAL PROTECTION

All our vehicles are covered by a "Third Party Liability" policy. You can also take out optional insurance: driver, passengers, damage and glass breakage.

The conditions and limitations of the compulsory or optional insurance, the contractual guarantees, as well as those of the assistance contract are available in all agencies.Material damage and theft of the vehicle are at the customer's expense, subject to an excess. In order to protect you against the inconvenience of damage, HERTZ offers you the CDW (damage deductible) supplements.

Partial Damage Waiver :

The Partial Damage Waiver is an optional coverage that allows you to reduce the deductible amount partially, except in the case of theft, attempted theft or vandalism. The amount of the damage excess will be reduced by half. This cover is applicable if the vehicle is used in accordance with the terms and conditions of the rental contract.

Total Damage Waiver :

The Total Damage Waiver is an optional benefit that allows you to reduce the deductible amount completely, except in the case of theft, attempted theft or vandalism. This guarantee is applicable if the vehicle is used in accordance with the terms and conditions of the rental contract.

In the event of a total deductible reduction, a non-refundable deposit is required to cover the loss of vehicle documents, loss of keys, extra day's expenses or other expenses not covered by the Total Deductible Reduction insurance.Personal effects are not covered.

STARC SAS will however retain 30% of the amount of the prepaid reservation as compensation for the immobilisation of the vehicle borne by the Hirer and the costs incurred in the preparation of the reservation file.

We will refund the prepaid amount minus the cancellation / no-show fee if you make a claim to Hertz Morocco within 90 days of the rental date and enclose a copy of your booking confirmation.
DEDUCTIBLES & OPTIONAL BENEFITS (INCL. TAX)

Damage to tyres, rims and punctures, towing costs, damage to or theft of accessories (rear-view mirror, antenna, indicator, headlight), damage caused by water (rain, sea) due to negligence, interior damage, Damage to the underside of the vehicle due to improper use of the vehicle, damage caused off a paved road, and more generally all damage due to use that does not comply with the manufacturer's standards shall be borne by the customer even if the excess reduction insurance (CDW) has been taken out.

In the event of loss of keys, all locks must be changed, and the customer will be charged the full amount of these costs. The replacement of keys due to damage will be charged to the customer. Failure to return the vehicle keys following theft will result in the vehicle being invoiced. Material damage to the vehicle caused by an unauthorised driver is entirely at the hirer's expense.

Material damage to the vehicle is only covered in the case of an accident with an identified third party and on production of an accident report within 24 hours. Theft or damage to the vehicle must also be reported to the police or gendarmerie. The absence of these documents implies the full payment of the damage by the customer.
PAYMENT

Payment

The Hirers are jointly and severally liable for the payment of the cost of the hire.

The estimated cost of the rental and services is payable in advance. It includes: the rental price, calculated according to the rates in force at the time of signing the contract; any fees or costs of additional options accepted by the Hirer, the various contributions relating to the guarantees or additional insurance taken out; plus the security deposit, if applicable, as well as the fuel service assessment.

For any payment made by means of a bank card, the principal driver must be the holder of the card. However, for the amount of the security deposit, only an authorisation will be required at the start of the rental. On return, the amount of the balance of the invoice, if any, will be automatically debited from the account corresponding to the card presented, unless the Hirer presents another means of payment accepted by the Hirer, subject to the application of the stipulations of the article below relating to advance payment, if applicable. The Hirer hereby accepts the debit to this same account of the amount of the non-redeemable deductible and of all other expenses that would be directly or indirectly linked to the vehicle, to its rental or to the use that would have been made of it by the Hirer (fuel, repairs, fines, ...).

Default of payment

If the payment deadline is exceeded, as shown on the invoice by the due date, the hirer shall be liable for a late payment penalty on the sum equal to 3 times the legal rate in force.

The hirer expressly accepts that :

  • Failure to pay or any unpaid amount will result in the forfeiture of the term for the unpaid invoices and the termination of the contract by right;

  • The Hirer requires the immediate return of the vehicles during the rental period.

Guarantee deposit

The amount of the guarantee deposit depends on the one hand on the category of the rented vehicle and on the other hand on the additional guarantees subscribed. It is intended to cover the loss suffered by the lessor as a result of damage or theft of the vehicle. The amount is indicated in the table above (Section Deductibles and Optional Guarantees) and is equal to a minimum of 2400 MAD including tax. It is reminded at the beginning of the rental, on your contract. If the hirer has not taken out contractual cover (theft and/or damage), the security deposit will be equal to the amount of the hirer's liability limit, which varies according to the category of vehicle made available and is indicated in the table above.

If the hirer has taken out contractual cover for damage (MENTION CDW shown or ticked on the contract) and theft (MENTION TW shown or ticked on the contract), only a deposit equal to the amount of the non-redeemable excess remaining payable by the hirer in the event of damage or theft will be claimed.

The deposit may be limited or excluded depending on the optional additional contractual guarantees which reduce or eliminate the non-redeemable excess (see article "damage and/or theft guarantee" below).

The security deposit shall be forfeited to the lessor in the event of damage attributable to the lessee or in the absence of fault on the part of an identified third party and in the event of theft of the vehicle (except in the event of application of the contractual guarantees set out below) and this up to the amount of the loss suffered.

In the absence of damage and/or theft and of any other expenses that are directly or indirectly related to the vehicle, its rental or the use made of it by the Hirer (fuel, repairs, fines, tyres, etc.), the amount of the security deposit actually paid will be reimbursed at the end of the rental period, subject to the collection period.

Conditions for advance payment or prepayment

In case of prepayment of the rental, the following provisions are applicable :

1- The rate subject to prepayment cannot be discounted, nor can it be combined with any other promotional offer. The confirmation of prepayment received by e-mail or by post is not transferable.

2- The rate excludes all additional costs not expressly mentioned as included in the advance payment booking confirmation as well as any additional optional services which remain the responsibility of the client. A valid credit card must be presented at the rental counter at the time of pick-up to cover in advance any additional supplements not included in the prepayment. Bank authorisation by this card is required at the start of the rental, the amount of any supplements attached to the rental being debited only on return of the vehicle.

3- A non-redeemable excess may be applied if the vehicle is stolen or damaged for any reason whatsoever, even if accident and/or theft cover has been taken out or is included in the rental charge.
MODIFICATION - CANCELLATION - NO-SHOW

Modifications :

You can change your booking by contacting the booking office by e-mail at Reservation@gbhmaroc.ma together with your booking confirmation. Requests for changes are subject to the following rules :

  • If your change request is made 48 hours prior to the day of pick-up, we will make the change for a change fee of 100 MAD/ VAT included;

  • If your change request is sent less than 48 hours before the departure date of your rental, you will be charged a change fee of 150 MAD/TTC;

  • Any modification made after the date of pick-up of the vehicle will be processed at the delivery agency according to availability and information that will be communicated to you on site. In addition, no refunds will be given for any rental shorter than the duration of the booking (early return), for late pick-up, for changing the category to a lower one or for cancelling the One-Way fee.

Any complete shift in rental dates will result in a recalculation of the rent according to the rate in force on the site on the date of receipt of your e-mail.

Cancellation :

All cancellations must be sent to the central reservation office by e-mail to Reservation@gbhmaroc.ma, together with the reservation confirmation, and will take effect on the date and time of receipt recorded by our computer system. Any cancellation request will be subject to the following conditions :

  • If your cancellation request is made 48 hours before the start of the rental period, a handling fee of 240 MAD/TTC will be applied. The refund will be made to the credit card used for the original booking;

  • If your cancellation request is sent less than 48 hours prior to the rental start date, no refund will be due;

  • No refunds will be due for any cancellation requests received less than 48 hours prior to the start of the rental period.

No show :

If you do not cancel your booking before the departure time and do not show up to collect the vehicle on the departure date, or if you do not meet the requirements for collection (see above), no refund will be due for loss of profit due to the fact that the vehicle reserved for you could not be hired.

No show due to breach of the terms and conditions of hire :

For the purposes of the rental of the vehicle, STARC, in its capacity as Renter, will proceed with a request to the customer's bank, which the latter will have designated, for a pre-authorisation of the amount of the deposit useful for the duration of the rental of the reserved vehicle.

In case of refusal by the bank to proceed to this pre-authorisation, the reservation for the rental of the vehicle will be cancelled and the client will not be entitled to a refund of the amount of the prepaid reservation.
LIABILITY FOR DAMAGE TO THE HIRED VEHICLE OR THEFT

You are responsible for the vehicle in your care.

In the event of an accident, with or without an identified third party, you must fill in an accident report form and submit it to your agency within a period not exceeding 24 hours.If not, and if the Hirer is called into question by an opposing insurance company, then you will be liable for processing fees amounting to 1200.00 MAD including tax.

At the end of the rental period, in the event of damage or theft, you will be charged an amount equivalent to the non-redeemable excess (see table above). If the amount of the loss actually suffered by the Hirer is higher than this sum, an invoice for the difference will be sent to you. If the damage suffered by the Hirer should be reduced (discovery of the vehicle within 60 days, sharing or total responsibility of a third party...), the hirer(s) will be reimbursed up to this reduction. This liability is limited if you have subscribed to the "reduced liability" guarantees in case of damage and/or theft set out in the article below.

LIMITATION OF LENDER'S LIABILITY

No provision of these general terms and conditions is likely to affect the legal provisions protecting the consumer or to exclude or limit any liability in the event of death or injury resulting from the negligence or fraudulent maneuvers of the Lender.

You expressly acknowledge and agree that the Lender, its officers, and employees shall not be liable for any indirect damages such as loss of turnover, customers, data, and any other intangible loss (including in the event that the Lender has been informed of such a risk) resulting from the reservation and prepayment.

OUR OPTIONAL CONTRACTUAL WARRANTIES

WARNING: all of these protections only apply on the territory, during the rental contract and subject to compliance with the provisions relating to age and possession of a driving license, authorized use of the vehicle, and return of the vehicle under the present conditions.

Damage and/or theft warranty

To reduce your liability to the amount of the non-redeemable deductible, you have the possibility to subscribe to the contractual guarantee in case of damage ("CDW") and/or theft of the rented vehicle ("TP" or damage and theft pack "SCDW" mentioned or checked on the contract or any other identical or similar pack, if applicable) when it is not included in our rates.

You can also take out additional optional warranties covering damage and theft which allow you to reduce the non-redeemable deductible or cancel it depending on the type of vehicle (tourism, utility, prestige). These additional warranties, called Super Damage and Theft Warranty (SCDW), Serenity Pack (COMFORT), Serenity Plus Pack (COMFORT+) (or any other pack that may be created) are explained in our agencies.

The subscription to the above-mentioned guarantees is concluded at the start of the rental for a flat rate per day of rental and is indicated by the corresponding symbol which is mentioned or checked on the contract; the amount of the deductible that may still be due is also specified.

WARNING : these guarantees, even when they offer a total redemption of the deductible, do not cover "top of body", "under body" and tire damages or the following forfeitures of guarantee which remain fully applicable.

Damage and theft of transported goods are also excluded from any warranty. Depending on the level of warranty subscribed, you may be charged, for each claim, the amount of the non-redeemable deductible or the reduced non-redeemable deductible, variable according to the category of vehicle, which is indicated on the contract, at the start of your rental and in the above table. If the amount of the prejudice actually suffered by the lender is lower than this amount, only the lower of the two sums will be due to you.

If your liability is totally cleared, and once reimbursement has been obtained from the responsible third party, this sum will be fully refunded to you.

FORFEITURE OF WARRANTY

Drivers not designated in the Rental Contract, and for whom the Renter remains responsible, will not be entitled to benefit from the Damage or theft warranties of the vehicle. The failure to comply with any of the obligations expressly stipulated in these General Terms and Conditions will result in the forfeiture of the contracted warranties. The Renter(s) will then be held responsible for the entire claim under the conditions of common law liability.

JURISDICTION CLAUSE

Jurisdiction is granted to the courts of the place where the car rental service is rendered, i.e. the place where the vehicle made available for rent is located.

Any dispute between merchants arising from this contract that could not be resolved through an amicable agreement shall, to the extent permitted by law, be the jurisdiction of the court where the Lender's registered office is located.

COMPUTER AND FREEDOMS

The information collected by the Lender is necessary to allow for vehicle rentals and related operations (reservations, billing...). The Renter is informed that this information will be stored in a computerized database, which is intended in whole or in part for the Lender, companies belonging to the Lender's Group, their franchisees, and partners.

The Renter may consult the information concerning him/her at any time to allow him/her to verify and rectify his/her personal data upon request addressed to the head office of our company : STARC SAS, 25 rue El Ouraïbi Jilali - CASABLANCA - MOROCCO.
